Reason - Clear Communication

 Dear Attorney Collins,

At the courtroom on 2/24/2010 it was mentioned that you were out sick so this letter is first to say that I hope that you make a full recovery from whatever the condition is. Secondly, I can not tell you how disappointed I was to once again have my parents and supporters come to court with me only to find out that it will need to be rescheduled again due to lack of discovery information provided to you from the Asst. D.A. and your illness. It was stated that you had sent an email notifyiing certain ones that you would not be there on the court date because you were bad sick so it has been put off until 3/17/2010. Is this due process? How many times do I have to go to court for 5 minutes at a time to find out that it has been put off. Upon leaving the courtroom a bystander said that they had saw you the day before. My concern is still the lack of communication. A simple phone call to me or the bondsman could have at least saved my parents a trip to TN for the 7th time even if it is protocol for me to be there according to Rene your secretary.

In light of Karl D. Warden my civil attorney falsifying that I agreed to the civil concession to the civil lawsuit filed by the State, I felt it necessary to write this letter and send it to you notarized.

To date I have had no verbal or written concession that I have agreed to concerning the criminal charges. To date you and I have not went over any discovery or discussed any type of plea deal or anything to sentencing. I am requestiing to be at all meetings concerning any discussions about my case and currently wish that you would aggressively fight to have this case dismissed on the merits that you indicated in the filed motions. In the event that you are not able to get it dismissed, please be advised that I am full aware of the consequences of going to trial and am prepared to do so.

In the event that you feel that you can't, won't or will not represent me ethically and fairly, l welcome another attorney who will. As I told you before, I know that you are more than capable to properly represent me but with communication being as it has been I can not help but to be leary whether my interest are being prioritized.

I look forward to speaking with you anytime regarding this case and will help in any way I can. Thanks for your attention to this concern.

Sincerely,

Marcus D. Jones
