He falsified to Judge Barbara Haynes by telling her that I conceded to a huge judgement filed against me by the State of TN and now will not return calls or emails and will not release my files to me that I submitted to him. He and his nemisis Suzanna Robinson will not return calls, emails or anything. I will be adding the washpot info about my dealings with him. I have been emailing him and calling him since 2/17/2010 and not once has he personally responded nor his secretary about the statuts of my case. I wil explain why he hasn't later on but for starters here is my last email I sent him.
Hello, It has been more than 2 weeks since the news reported that a default judgement went against me. I have emailed you several times to see if you all would even mention anything to me about it. Surely you have the order at your office or know something about this as my Civil Attorney. Two weeks later and still not a single call, email, correspondence or anything from you or Suzanna your paralegal. I had to find out from friends who told me about the newscast instead of my civil attorney. I hired you to protect my rights and for counsel not to file a false concession saying I entered into a default judgement willingly. When did we discuss this? Where did I agree to this with you?
The last time I spoke with you, you were telling me to go ahead and resume work and to pay the amount we had talked about to the state fund and then all of a sudden I am banned in TN from doing cemetery tombstones. Is this what you discussed at the status hearing meeting that you said I did not have to attend after calling you? Was it you who conspired against me with them to deprive me of my rights as well? Is this what you teach the boy scouts you mentor, be a false witness and its okay? You have violated the very core of legal ethics by misrepresenting your client. I am sure you have through many years lost sensitivity to the truth and ethics but what you did stinks. You and Suzanna Robinson both were never in concert regarding basic issues of my case. I would call her and she would say one thing off the top of her head just to seem like she knew what she was talking about and then would retract after she found out that her information was wrong. Is this the protocol for your clients? I am not working so I have plenty of time to come to court and sit in on anything that is going on concerning me but you stole that right from me.
You returned calls to get me to pay the $2,500.00 but in the heat of the battle you sold me out and rheamed me in the system as did the others. No notification in anyway from you Attorney Warden or you regarding the news cast. As of 2/25/2010 I still have yet to receive in my hand or by email any court order banning me from doing business in the State. However, the last time I spoke with you Attorney Warden you told me to go ahead and resume and pay into the restitution package. Now its being reported that I have been banned and have these huge judgements against me. Where is my due process? It appears that you have chosen the path of least resistance instead of aggressively defending my rights through your legal duty. I am not mad- I suppose this is what you meant when you said welcome to my world. Right now you have joined those who have clearly misused their God given power and justify yourselves while doing it. May the Lord repay you according to the intent of your heart.
No questions that I have asked for your counsel on have been addressed. You have discussed nothing with my about appeals and not anything that has been on my behalf. Instead of you all honoring citizens you just got tired of seeing the case and deemed it complex because you don't won't to face the truth regarding Henry Wayne Monk's thievery and just decided to say I conceded to this to get it out of Judge Barbara Haynes docket and to side with the State. How rotten can one be. The so called Co-defendant that you said you would try to get separated from me I suppose since he had no money you just agreed with the State and the Court to just just threw him in their with me when you all know the truth. I have been saving all the emails I have sent to you regarding this case and preserving all the calls etc because I knew you were to good to be true. You just wanted the money and that was it and do not give a care about your clients or your ethics. The least you could have done was called me or allowed it to be heard in court fairly.
That's right a fair trial based on evidence not race, not emotions, not easy exit strategy's. But who has time to hear the truth in court, right? So just lie and say I said I give in and you have your $2,500.00 and on to the next one. I am going to ask you to refund at least half of my retainer fee by cash or check since you did half your job. I would like to have this refund at least by 12:00 Friday 2-26-2010. You can call me to insure that these arrangements are agreeable to you. My number is still the same. I know no attorney can guarantee anything but what good is it to have an attorney if you want do your job. I did not need you concede to a default judgment. I could have easily done this myself. If I do not hear from you by then. All emails and future letters will be posted online. I will file complaints with the board and start daily sending out all info the CNN, FOX and other news outlets as well as post it on my own website under civil attorney link. I will post with the BBB, Ripoffreport to see if they are biased or truth takers and any other blog I can write about you. Lastly, if I have to get a sign and come and stand in front of your office to protest and pass out leaflets about your firm I will. I know nashville is bought in so many ways but I am sure that some paper, newscast somewhere in these tough times would like to comment on this. If I can prevent one family from allowing you to extort them it will be worth it to me.

It is now 2/28/2010 and had I not heard on the news or from friends about this I certainly would not have heard anything from Attorney Karl D. Warden. I have no court order in my possession to date. I never spoke with him ever about consenting to any judgement and the reason I hired him was because there was a motion to move a temporary injunction into a permanent injunction. I will post what I have later on this. The day of the Status Conference I called him and he clearly stated that I did not have to be there even though I was in position to be there since he said that it would be a brief meeting. So he walked in if he went at all and filed his false concession on my behalf.

My experience has been awful. Immediately and consistently I found myself without a voice while the State Prosecutors had free course to speak, show up late and basically do whatever they wanted and say whatever they wanted to say. Several times when I went to court my case was not even on the dockets so had I left then I would have been charged with contempt or failure to appear so I had to wait for John Smitj III from the AG's office to arrive late, him and Nathan Casey and then after all the cases were heard they would add mine to the docket then in what is called open court. I will post emails later to confirm statements.
Prior to my hiring a civil attorney I went to court before her each time with the exception of two times I think. Most recently after paying an Attorney Karl D. Warden, he went to a meeting before her that is called a Status Hearing on my behalf and prior to the meeting I called him that morning to see if I needed to be in attendance and he encouraged me not to come by saying that it would be small talk and afterwards. Small talk it wasn't because afterwards they came out with a judgment over $300,000 against me with more than $100,000 of it in attorney fees. This judgment was filed falsely on my behalf by my attorney saying that I had agreed to a concessionary agreement to all of the lawsuit terms the State was shooting for. Judge Haynes ruled in the State's favor based on my fraudulent Attorneys false concession on my behalf.
